The website you have entered (its sub-domains, affiliated websites, any mobile versions, and any services available therefrom) (the “Site”) is a copyrighted work owned and operated by DMKTG CO. (“DMKTG”, “DMKTG Co”, “DMKTG.CO”, "DMKTG.SHOP", “we” or “us”).
Wix templates are for Wix websites ONLY and will NOT work with any other website platform
WordPress templates are for WordPress websites ONLY and will NOT work with any other website platform
Shopify templates are for Shopify websites ONLY and will NOT work with any other website platform
Canva templates are for Canva ONLY and will NOT work with any other design platform

Branding must remain in place (DMKTG, DMKTG.CO, DMKTG.SHOP, NOSIDEHUSTLE, NOSIDEHUSTLE.CO) Brand Assets (WEBSITE URLS, LOGOS with URLS) must NOT be removed (footer, etc) and remain in place

You do NOT have permission to redistribute this template or any edited derivative of this template except;

By purchasing one of DMKTG CO.’s Digital Products (from DMKTG.SHOP, Shopify, Etsy Stores) you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using as our brand may be associated within.
Purchase of a website template allows you to use the template for one site in your own account. You do not have permission to re-sell or re-distribute this template or any edited derivative of this template. DMKTG CO. does not give permission to claim the design or structure as your own. You must NOT remove the footer site link and text "(DMKTG CO., DMKTG.CO)"
You will receive the template as it is shown in the live demo URL that you are able to preview before purchasing. It is your responsibility to preview the live version of the template and ask questions if needed, before choosing to purchase.
Within 30 days of purchase: If any platform (Wix, Webflow, Shopify, WordPress, Canva) makes significant updates or changes to their platform and the template does not continue to function as a result, DMKTG CO. will provide a full refund of your purchase of the template. If an updated version of the template can be made, you will receive the updated version in place of a refund and this will be provided within 30 days of the change occurring. DMKTG CO. holds no responsibility for the changes on these platforms and cannot control the technical changes of external websites, therefore you agree to the Refund Policy of the item outlined at date of purchase. Beyond 30 days of purchase, a refund will not be provided.
2. Acceptable Use Policy
When using DMKTG CO. digital themes (on Wix, WordPress, Shopify, Webflow, for example), please ensure it follows our AUP and there is NO HARM to the DMKTG CO. brand.
This Acceptable Use Policy (this “AUP”) describes material and activities that are not allowed in connection with the Services/Brand offered by DMKTG CO.. This AUP is not exhaustive, and DMKTG CO. reserves the right to take remedial action in connection with content or uses that are not specifically described below. You are responsible for violations of this AUP by anyone using your account with your permission or on an unauthorized basis. Illegal or Abusive Activity or Content You may not use the Services/Brand for any unlawful or abusive purpose. Prohibited activities include: Illegal Activities. Any use of the Services to engage in, further, promote, or encourage illegal conduct or activities, including the dissemination of content that has been determined by a court of competent jurisdiction to be unlawful. Fraudulent or Harmful Activities. Engaging in activities that is deceptive or harmful to others, or that would harm DMKTG CO.’s operations or reputation, brand including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g., make-money-fast schemes, Ponzi and pyramid schemes, phishing, or pharming), deceptively impersonating another person or entity, or engaging in other fraudulent or misleading practices. Violation of Intellectual Property Rights. Using the Services in a manner that violates, infringes on or misappropriates the intellectual property or proprietary rights of any third party, including without limitation any rights in or to copyright, patent, trademark, trade secret, privacy or publicity, and publishing content intended to assist others in unlawfully circumventing technical measures intended to protect any such rights. Unlawful Pornography, depictions of nudity or sexual activity obtained or disseminated without the consent of those depicted (e.g., “revenge pornography”). Violent, Harassing, or Abusive Content. Content that incites or threatens violence against any person, promotes terrorism, is intended to harass, abuse or invade the privacy of any individual, creates a risk to the physical safety or health of any individual or to public safety or health, or that threatens or encourages harm on the basis of race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, serious disease or disability, or immigration status. Controlled Substances. Unlawfully selling or distributing controlled substances, including but not limited to any illegal or prescription drugs.
